If you have one of these drives from intel, you are eligible for a full refund of the purchase price (Kingston has a replace/assistance program in place)

Essentially, the drive is unable to encrypt at 256bit level due to a controller issue. As such it cannot be firmware fixed and therefore does not meet the advertised specs of the drive. If you purchased your drive on or before the 1st of July 2012, You can contact Intel support before the 1st of October and arrange for a refund.

If you have a drive using the Sandforce SF-2281 (Such as a Kingston) there are paralell programs in place for replacement when 256 encryption drives are available.
